Kentucky Product Liability Lawsuit

Federal and Kentucky State laws protect consumers from being held liable for damages incurred as a result of dangerous or defective products- but it's not that simple. The consumer's attorney must successfully argue that their client used the product as described for its intended purpose and establish a link between the injury and the defective product, as large manufacturing companies may allege that consumers misused a product.

Though product liability law aims to protect consumers, it places the burden of proof on the injured party, meaning it's up to the alleged victim to present evidence that shows a direct link between their physical injuries and the product defect. This makes it all the more important to find an attorney with solid experience in product liability lawsuits, like the personal injury attorneys at Crocker Law Firm PLLC in Kentucky. We will represent you against large manufacturing companies, and advocate for your rights under product liability law.

A product liability lawsuit was recently filed against Bayer Pharmaceuticals, the manufacturer of the Mirena intrauterine device (IUD), by a female Kentucky resident. Mirena is a form of birth control designed for direct insertion into the uterus to prevent pregnancy for up to five years. The IUD has recently been linked to a variety of serious side effects, including uterine perforation, pelvic inflammatory disease (PID), severe infections, infertility, amenorrhea, depression, abscesses, interstitial cystitis, pelvic pain, and numerous other injuries.

The Kentucky plaintiff is seeking compensation for alleged severe and permanent injuries, lost wages, medical expenses and pain and suffering she endured as a result of Mirena. According to the lawsuit against Bayer, the woman's physician discovered that the IUD had traveled outside of her uterus and adhered itself to one of her fallopian tubes just one year after the device was implanted. The removal of the device required laparoscopic surgery.

This plaintiff isn't alone in her unfortunate situation: Thousands of other women have experienced an assortment of negative side effects allegedly caused by Mirena. Numerous lawsuits have been filed against Bayer, on the grounds that the pharma-giant neglected to adequately warn the public about the serious risks associated with the product. According to the Kentucky plaintiff, Bayer was aware of the significant risks the product carries, and therefore had an obligation to warn potential users of the risks related to the use of the birth control device.

Previously, the FDA has warned that this product can cause perforation of the uterine wall, ectopic pregnancy, Group A streptococcal sepsis and pelvic inflammatory disease.

If you or a loved one has been harmed as a result of a defective product, you may be eligible to receive compensation.
